As a condition of, and in consideration for, your access to and use of the Website and its services and features, you (also referred to in these Terms of Service as “you”, “your” and “user”) agree to be bound by these Terms of Service (the “TOS”) and by the Quality Rent to Own Privacy Policy, which is fully incorporated into these TOS. These TOS are a legally binding agreement between you and Quality Rent to Own. Any use of or access to the Website or its services means that you accept and agree to be bound by these TOS. What we do, and what we do not do

At Quality Rent to Own, we provide home listings and resources that are curated by our team and sent to you. Our goal is to help you find and learn about homes and paths to owning a home of your own.

We are in no way providing mortgages, or lending for the purchase of a home. We are merely presenting listings.
We are not a mortgage broker or a mortgage lender, we are not affiliated with any mortgage company, and we do not sell homes.
All products and services provided by Quality Rent to Own are for educational and informational purposes only. Nothing on the Website or in our messages is legal, tax, financial, or lending advice.

There is no guarantee that you will own a home by using the listings and resources we provide. We do not guarantee the availability of any listing, the terms any seller or third party may offer, or any approval. Any testimonials or examples are not intended to represent or guarantee that you will achieve the same results.

Modification

Quality Rent to Own reserves the right to modify, alter, or discontinue, temporarily or permanently, any service or any part of a service, with or without prior notice, at any time and in its sole discretion. Quality Rent to Own will not be liable to any user for any such alteration, modification, suspension, or discontinuance of the services or any part of them.

We may also change these TOS. Your continued use of the Website or its services after a change to these TOS is posted means you accept the change, so please review these TOS regularly to stay aware of the terms currently in effect. If you do not agree to a change, you must stop using the Website and its services.

Privacy Policy

Quality Rent to Own respects your privacy. By using the Website and the services and features it provides, you understand and consent to the collection, use, and handling of your personally identifiable information and non-personally identifiable information as described in more detail in the Quality Rent to Own Privacy Policy at https://qualityrent2own.com/privacy.html. We do not rent or share your personal information. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes, and text-messaging originator opt-in data and consent will not be shared with any third parties.

Text messaging program

Quality Rent to Own respects your privacy and is committed to protecting your personal information. We do not sell, rent, trade, or share your personal information with third parties for their marketing or promotional purposes.

SMS Consent and Mobile Information: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent will not be shared, sold, rented, or disclosed to any third parties or affiliates for their own marketing purposes.

We may disclose information to trusted service providers solely as necessary to operate our services, deliver requested communications, or comply with applicable legal requirements. These providers are required to protect your information and are prohibited from using it for independent marketing purposes.

Texts in our text-message program are sent by Quality Rent to Own. Our sign-up form has two separate, optional consent boxes, one for each kind of text. If you choose to join our text-message program, the following terms apply:

Service updates and account notifications. By checking the box for service updates and account notifications, you give your express consent to receive recurring automated service updates and account notifications texts from Quality Rent to Own at the phone number you provide.
Marketing communications and promotions. By checking the separate box for marketing communications and promotions, you consent to receive marketing communications and promotions from Quality Rent to Own at the phone number you provide. We send marketing and promotional texts only if you check this box.
Rates and frequency. Message and data rates may apply. Message frequency varies.
Opting out. You can opt out at any time by replying STOP to any message. After you reply STOP, you will receive no further texts from Quality Rent to Own unless you opt in again.

Consent is not required to sign up or buy. Neither consent box is required to sign up, and consent to receive text messages is not a condition of purchasing any products or services. A phone number is required only if you check either box.
Your number is not shared. Your mobile number will not be shared with third parties or affiliates. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes, and text-messaging originator opt-in data and consent will not be shared with any third parties.
Carriers. Mobile carriers are not liable for delayed or undelivered messages.

Minors

Persons under 18 years of age (or the applicable age of majority, if greater than 18) are not permitted to use the Website. Quality Rent to Own does not knowingly solicit or collect information from persons under 18 years of age. By using the Website, you affirm that you are 18 years of age or older and are fully able and competent to enter into these TOS.

Use of the Website

Quality Rent to Own authorizes you to view or download the files, documents, text, photographs, images, audio, video, and any other materials accessed through or made available for use or download through the Website (collectively, “Content”) solely for your personal, noncommercial use. You may not copy, distribute, modify, create derivative works of, reproduce, publish, or use, in whole or in part, any Content for any commercial or other purpose except as explicitly authorized by these TOS. You may not use any computerized or automatic mechanism, including without limitation any web scraper, offline reader, spider, or robot, to access, extract, or download any Content from the Website unless Quality Rent to Own has expressly authorized you to do so.

User conduct

You agree to access and use the Website and its services only for lawful purposes. You are solely responsible for knowing and following all laws, statutes, rules, and regulations that apply to (i) your use of the Website and its services, (ii) your use of any networks or other services connected to the Website, and (iii) any means by which you connect to the Website and its services. You are solely responsible for the substance of everything you submit or post to the Website. You agree not to:

restrict or inhibit any other user from using and enjoying the Website or its services;
post or transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, pornographic, or indecent information of any kind, including without limitation any transmission that constitutes or encourages conduct that would be a criminal offense, give rise to civil liability, or otherwise violate any local, state, national, or international law;
post or transmit any information or other material that violates or infringes the rights of others, including material that invades privacy or publicity rights, or that is protected by copyright, trademark, or other proprietary rights, or derivative works of such material, without first obtaining permission from the owner or holder of those rights;

claim a relationship with, or speak on behalf of, any business, association, institution, or other organization that you are not authorized to represent;
copy or collect any Content by robots, spiders, scripts, scrapers, crawlers, or any automated or manual equivalent;
copy, adapt, create derivative works of, decompile, reverse engineer, translate, localize, port, or modify any application programming interface, website code, or software used to provide the Website or its services; or
use the Website or its services in any manner or for any purpose that infringes, misappropriates, or otherwise violates any intellectual property right or other right of any person, or that violates any applicable law.

Right to regulate

Quality Rent to Own retains the right to regulate access to and use of the Website and its services in its sole discretion. You agree not to bypass any such regulation. You further agree that Quality Rent to Own is not liable for regulating or not regulating, and that no action or inaction by Quality Rent to Own is a waiver of any right to regulate.

Proprietary rights

You acknowledge, understand, and agree that all Quality Rent to Own trademarks, copyrights, trade names, service marks, logos, and other brand features and names are, and shall remain, the sole property of Quality Rent to Own. You agree not to display or use the Quality Rent to Own logo or marks in any manner.

Third-party listings and links

Listings and links may lead to properties, sellers, or websites that are operated by third parties. Quality Rent to Own does not control and is not responsible for third-party content, terms, or policies, and any arrangement you make with a third party is solely between you and that third party.

Disclaimer and limitation of liability

To the full extent permitted by law, Quality Rent to Own and its officers, directors, employees, agents, licensors, and successors in interest (collectively, “Quality Rent to Own”):

make no promises, warranties, or representations about the Website or its services, including their completeness, accuracy, availability, timeliness, propriety, security, or reliability;
provide the Website and its services on an “AS IS” and “AS AVAILABLE” basis, and any risk of using the Website or its services is assumed by you;
disclaim all warranties, express or implied, including as to accuracy, merchantability, fitness for a particular purpose, and non-infringement, and all warranties arising from a course of dealing, usage, or trade practice; and
disclaim any liability or responsibility for the acts, omissions, or conduct of any user in connection with the Website or its services.

Quality Rent to Own shall NOT be liable for any direct, indirect, consequential, incidental, special, punitive, or other losses, including lost profits, revenues, data, or goodwill, arising from or related to the Website or its services, and in no event shall such liability exceed $100. Some jurisdictions restrict or alter these disclaimers and limits, so some of them may not apply to you.

Choice of law and forum

These TOS are governed by the laws of the United States and the State of Iowa, without regard to conflict of law provisions. You agree that any cause of action that may arise under these TOS shall be commenced and heard in the appropriate court in Linn County, in the State of Iowa, and you agree to submit to the personal and exclusive jurisdiction of the courts located in Linn County, in the State of Iowa. You agree to waive all rights to trial by jury. Regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to the use of the Website or its services must be filed within two (2) years of the date on which it arose, or the date on which it could reasonably have been discovered, or it shall be forever barred.
